At the time of issuance of a building permit the permittee of a development permit under chapter 1 of this title shall pay an erosion control fee in the amount established from time to time by resolution of the town council. Upon the first to occur of the filing of a subdivision plat or the execution of a subdivision improvement agreement pursuant to section 9-2-3-6 of this title, the permittee of a subdivision permit under chapter 2 of this title shall pay an erosion control fee in the amount established from time to time by resolution of the town council.
