A. Preliminary Hearings; Class A And Class B Developments: Notice of the first preliminary hearing, for all Class A applications and for all Class B applications within the historic district, shall consist of the following:

1. A notice containing the following information:

a. The date, time and place of the hearing.

b. A general description of the property (address).

c. The purpose of the hearing.

d. Where additional information may be obtained.

e. A description of the request. (Ord. 19, Series 1988)

2. Notice shall be provided by the following means:

a. The notice shall be posted on or outside the southerly front door of Town Hall not less than twenty four (24) hours before the hearing. Inclusion of such notice within the posted planning commission agenda shall be sufficient to meet the requirements of this section. (Ord. 10, Series 1996)

b. The notice shall be posted on the property not less than eleven (11) days, nor more than eighteen (18) days, prior to the planning commission hearing. All public street frontages shall be posted with at least one notice of public hearing.

c. Notice shall be mailed by the town by first class mail to all property owners whose property lies within three hundred feet (300') of the subject property, not less than eleven (11) days nor more than eighteen (18) days, prior to the planning commission hearing for all Class A and B development permit applications. B. Final Hearing; Class A And Class B Developments: Notice of a final hearing for all Class A and Class B final applications shall consist of the following:

1. A notice containing the following information:

a. The date, time and place of the hearing.

b. A general description of the property (address).

c. The purpose of the hearing.

d. Where additional information may be obtained.

e. A description of the request. (Ord. 19, Series 1988)

2. Notice shall be provided by the following means:

a. The notice shall be posted on or outside the southerly front door of Town Hall not less than twenty four (24) hours before the hearing. Inclusion of such notice within the posted planning commission agenda shall be sufficient to meet the requirements of this section. (Ord. 10, Series 1996)

b. The notice shall be posted on the property not less than eleven (11) days, nor more than eighteen (18) days, prior to the planning commission hearing. All public street frontages shall be posted with at least one notice of public hearing.

c. Notice shall be mailed by the town by first class mail to all property owners whose property lies within three hundred feet (300') of the subject property, not less than eleven (11) days nor more than eighteen (18) days, prior to the planning commission hearing for all Class A and B development permit applications. C. Site Visits: Site visits for Class A or Class B applications shall be noticed in either of the following manners:

1. When the time and place for a site visit is scheduled at a planning commission hearing, the planning commission chairman or community development director shall announce the time, place and general nature of the site visit at the end of the hearing, prior to the next agenda item. (Ord. 19, Series 1988)

2. When the time and place for a site visit is scheduled outside of the planning commission hearing, the time, place and general nature of the site visit shall be posted on or outside the southerly front door of Town Hall not less than twenty four (24) hours before the site visit. Inclusion of such notice within the posted planning commission agenda shall be sufficient to meet the requirements of this section. (Ord. 10, Series 1996)

3. Nothing herein shall require notice for site inspection by an individual planning commission member outside of the hearing process. (Ord. 19, Series 1988)

D. General Notice Procedures:

1. Notice shall not be required prior to the review of any Class C, Class D major, or Class D minor application, nor for a preliminary hearing for a Class B application outside of the historic district. (Ord. 1, Series 2014)

2. Failure of a person to receive the notice described in this section shall not impair the validity of the hearing, or any action taken on the application by the planning commission or town council following such hearing.

3. The notice provisions of this section shall not restrict the giving of notice by other means. (Ord. 7, Series 1993)

4. A Planning Commission decision which is called up by the town council shall be noticed in the same manner as required for review by the Planning Commission for final hearings, except that notice shall also be posted on or outside the southerly front door of Town Hall not less than twenty four (24) hours before the hearing. Inclusion of such notice within the posted Planning Commission agenda shall be sufficient to meet the requirements of this section. (Ord. 10, Series 1996)

5. Notice to multi-unit properties that are represented by a condominium or homeowners' association or management agency may be given to the association or management agency, rather than to each individual unit owner. (Ord. 7, Series 1993)
