A. As used in this section, the following words shall have the following meanings:

MOTOR VEHICLE: As defined in the town's traffic code adopted by reference in title 7, chapter 1 of this code.

PEDAL BUS: As defined in the town's traffic code adopted by reference in title 7, chapter 1 of this code.

PEDICAB: As defined in the town's Traffic Code adopted by reference in title 7, chapter 1 of this Code.

REFUSE: As defined in section 5-6-3 of this Code.

RIVERWALK: The area comprised of Town owned easements and fee interests in real property which is located adjacent to and easterly of the Blue River between Ski Hill Road and South Park Avenue where the town has constructed public improvements in order to make the area more attractive for use by the residents of, and visitors to, the town.

B. Except as provided in subsections C, D and E of this section, where signs are erected giving notice thereof, it shall be unlawful for any person to operate or park a motor vehicle anywhere within the Riverwalk.

C. Between the hours of four o'clock (4:00) A.M. and ten o'clock (10:00) A.M. of the same day, it shall be lawful to operate or park a motor vehicle within the Riverwalk for the limited purposes of: 1) removing refuse from trash enclosures or properties located adjacent to the Riverwalk; 2) making deliveries of merchandise to or picking up merchandise from commercial establishments located immediately adjacent to the Riverwalk.

D. Between the hours of seven o'clock (7:00) A.M. and six o'clock (6:00) P.M. of the same day, it shall be lawful to operate or park a motor vehicle within the Riverwalk for the limited purpose of picking up or delivering the United States mail or other mail or similar parcels sent via a commercial package or mail delivery service.

E. Nothing in this section shall preclude the operation or parking of a motor vehicle within the Riverwalk by: 1) an employee of the town while engaged in the performance of such person's duties; 2) any law enforcement personnel while engaged in the performance of such person's duties; 3) any employee of a utility provider responding to a bona fide emergency; or 4) the owner or other authorized user of the private parking spaces and/or private loading easement located within Parcel B of the Tiger Dredge Subdivision as shown on the plat thereof recorded June 4, 1991, under reception no. 404259 of the records of the Clerk and Recorder of Summit County.

F. It shall be unlawful for any person authorized by this section to operate or park a motor vehicle within the Riverwalk to fail to conform such person's use of the Riverwalk to the following requirements:

1. Between Jefferson Avenue and Adams Street, motor vehicles shall be driven along the Riverwalk only in the northerly direction.

2. The driver of a motor vehicle shall not operate such vehicle at a speed greater than five (5) miles per hour.

3. The driver of a motor vehicle shall yield the right-of-way to a pedestrian within the Riverwalk, slowing down or stopping if need be to so yield.

4. No person shall park a motor vehicle for any purpose or length of time in excess of thirty (30) consecutive minutes.

5. All motor vehicles shall be operated only upon the paved portions of the Riverwalk.

6. Any motor vehicle parked within the Riverwalk shall be parked with the left hand wheels parallel to and within twelve inches (12") of the left hand edge of the paved surface of the Riverwalk, and in an area where at least twelve feet (12') of clearance exists between the right hand wheels of the vehicle and the opposite edge of the paved surface of the Riverwalk.

7. No motor vehicle shall be allowed to idle for more than ten (10) consecutive minutes; provided, however, that such limitation shall not apply to refrigeration unit motors.

8. No person shall permit any motor vehicle under such person's control to deposit any motor vehicle fluids (other than water) or noxious liquids or substances upon the Riverwalk.

G. It is unlawful to operate a pedal bus or a pedicab on the Riverwalk unless authorized by a special event permit issued pursuant to title 4, chapter 13 of this Code.

H. Any person convicted of violating any provision of this section shall be punished as provided in title 1, chapter 4 of this Code; provided, however, that no conviction related to or arising from the operation of a motor vehicle shall be reported to the Colorado department of motor vehicles for the purpose of the assessment of points against the operator's license of the person convicted of such offense.
