As a prerequisite to filing a civil action in a court of competent jurisdiction, a person challenging a decision of the public works director shall file an appeal in writing with the manager. An appeal submitted under this section of the code must set forth the factual basis for the appeal. The manager or their designated hearing officer shall conduct a hearing in a timely matter and in accordance with procedures in title 1, chapter 19 of this code; provided, however, any decision of the finance or public works director, as the case may be, shall be a final decision of the town, and may be appealed to the district court pursuant to Rule 106(a)(4) of the Colorado Rules of Civil Procedure.
