A. Every person convicted of violating any provisions of this chapter shall be punished as provided in section 1-4-1 of this code. Upon conviction, the court may additionally order restitution for the reasonable and necessary costs incurred by any governmental or quasi-governmental agency or authority who was required to respond to and extinguish such open burning.

B. In addition to the penalties provided for in subsection A of this section, any person who conducts open burning in violation of any provision of this chapter, or in violation of the terms and conditions of a special permit issued pursuant to this chapter, shall be personally liable for the reasonable and necessary costs incurred by any governmental or quasi-governmental agency or authority who is required to respond to and extinguish such open burning. Such liability may be enforced by the responding agency or by civil suit in any court of competent jurisdiction. If more than one person shall be determined to be liable for such costs, such liability shall be joint and several. (Ord. 21, Series 1994)

C. In addition to other remedies available to the town, the town may commence an action pursuant to section 1-8-10 of this code to enjoin the alleged violation of any provision of this chapter. (Ord. 7, Series 2001)
