All unpaid water charges shall constitute a personal debt due and owing to the town by the owner of the water using property to which the water was delivered by the town, and the town shall have the right to recover on such debt by judgment and execution thereon in the civil action in any court of competent jurisdiction. If there was more than one owner of a water using property when the water service was provided by the town, the liability of such owners for water charges is joint and several. In connection with any such action the town shall have the right to recover its reasonable attorney fees incurred in connection with such action. (Ord. 9, Series 2001)
