Wetlands disturbance is prohibited unless the developer submits a variance request per section 10-4-9 of this Code which is duly approved by the town engineer showing that developer meets the criteria for exemption set forth in section 10-2-4-4 of this chapter. If a variance is approved, all wetlands disturbance will require wetlands mitigation per the engineering design standards and construction specifications. (Ord. 3, Series 2022)
