A. Any defendant charged with a violation of this Code or any Code adopted by reference herein, other than an "infraction" as defined in section 1-3-2 of this title, shall have the right to demand a trial by jury upon compliance with the provisions of State law and the Colorado Municipal Court Rules of Procedure.

B. No defendant shall have a right to trial by jury for any "infraction" as defined in section 1-3-2 of this title.

C. In the event that a defendant is charged with more than one (1) offense arising out of the same episode or incident and at least one (1) of the offenses charged is a misdemeanor offense or a criminal traffic offense, or if the defendant is charged with any other criminal violation arising out of the same incident or episode, the defendant shall have the right to demand and, if such demand is in conformance with State law and the Colorado Municipal Court Rules of Procedure, receive a trial by jury as to all such offenses, which shall be consolidated for purposes of trial.
