A. It is unlawful for any person to violate any ordinance of the town, this code, or any code adopted by reference. Each violation is a misdemeanor offense, except those violations specifically classified as infractions in any town ordinance, this code, or any code adopted by reference. Any person convicted of a misdemeanor violation of this code, any ordinance of the town, or any code adopted by reference, shall be punished by a fine of not more than two thousand six hundred fifty dollars ($2,650.00), or by imprisonment not to exceed one year, or by both such fine and imprisonment; provided, however, that no person under the age of eighteen (18) years as of the date of the offense for which he is convicted shall be subject to a jail sentence, except in the case of a conviction of a traffic offense under title 7 of this code. Any persons found to have committed a violation of an infraction shall be punished as provided in section 1-4-1-1 of this chapter. The maximum amount of the fine that may be imposed under this section shall automatically be increased annually as provided in section 13-10-113(1)(b), Colorado Revised Statutes. B. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any misdemeanor provision of the ordinances of the town, this code, any code adopted by reference or any regulation adopted pursuant to this code or town ordinance is committed, continued or permitted by any such persons, and he shall be punished accordingly.
